These terms govern your use of WSIQ Bids, including bidding, hosting live shows, and buying or selling wristwatches on the platform. Please read them before you bid.

1. Acceptance of these terms

WSIQ Bids (“WSIQ Bids”, “we”, “us”) operates an online platform for live and timed auctions of wristwatches. By creating an account, bidding, hosting a show, or listing a lot, you agree to these Terms & Conditions. If you do not agree, do not use the platform.

You must be at least 18 years old and legally able to enter binding contracts to register or bid.

2. Our role

WSIQ Bids is a venue. Watches are sold by independent, approved seller stores, not by WSIQ Bids. The contract of sale is formed directly between the winning bidder and the seller. We are not the owner, importer, appraiser, or guarantor of any lot unless a listing explicitly states that WSIQ Bids is the seller.

3. Accounts and account security

You are responsible for the accuracy of your registration information and for all activity under your account. Keep your credentials confidential. Notify us promptly of any unauthorized use. We may suspend or terminate accounts for non-payment, misrepresentation, bid manipulation, harassment, or any breach of these terms.

4. Bidding is binding

Every bid you place is an irrevocable offer to purchase the lot at that amount. Bids cannot be retracted. If you are the high bidder when the lot closes, you are obligated to complete the purchase at the hammer price plus applicable buyer's premium, taxes, and shipping.

Bid increments, reserves, and the lot clock are enforced server-side. Bids placed in the final moments of a lot may extend the clock (anti-sniping); the lot closes only when the extended clock expires with no further bidding.

We may cancel a bid, reopen a lot, or void a sale where there is a technical failure, an obvious pricing error, suspected shill bidding, or a material misdescription.

5. Condition, authenticity and descriptions

All lots are sold as-is, where-is. Sellers must accurately disclose known service history, replacement parts, refinished or redialed components, aftermarket bezels or bracelets, non-original crystals, water-resistance status, and whether original box and papers are included.

Photographs, videos, and live streams are aids, not guarantees. Estimates are opinions and are not appraisals or warranties of value.

Sellers warrant that they own each lot free of liens, have the right to sell it, and that the lot is not counterfeit. Lots found to be counterfeit are void sales; the seller must refund the buyer in full including shipping.

Manufacturer warranties do not transfer unless stated. WSIQ Bids is not an authorized dealer for any brand, and no brand endorses this platform.

6. Fees

Buyers pay the hammer price plus the buyer's premium disclosed on the lot page at the time of bidding, plus applicable sales tax, duties, and shipping and insurance charges.

Sellers pay the seller commission and any listing or payment processing fees disclosed at listing. Fees are deducted from proceeds before payout.

7. Payment

Payment is due immediately on winning unless otherwise stated, and in all cases within 3 calendar days of the lot closing. We may charge the payment method on file.

Non-payment may result in cancellation of the sale, forfeiture of any deposit, relisting of the lot at the defaulting bidder's risk, recovery of resulting losses and costs, account suspension, and permanent loss of bidding privileges.

8. Shipping, risk and title

Sellers must ship within 3 business days of cleared payment, fully insured for the purchase price, with tracking and signature confirmation. Risk of loss passes to the buyer on delivery. Title passes on full payment.

Buyers are responsible for import duties, taxes, and compliance with local law. Some materials (for example certain exotic leather straps) may not be shippable to all jurisdictions; those straps may be removed prior to shipment.

9. Returns and disputes

Because lots are sold as-is at auction, sales are final except where a lot is materially not as described, is counterfeit, or arrives damaged in transit.

Claims must be opened with WSIQ Bids within 3 days of delivery, with photographs and a written description. Do not service, alter, or resell the watch before a claim is resolved. Approved claims require return of the watch in the condition received, insured, before a refund is issued.

WSIQ Bids may mediate disputes and may, at its discretion, withhold seller payouts pending resolution. Our mediation decisions on platform fees and payouts are final.

10. Live streams, chat and user content

Hosts and viewers must not post or transmit unlawful, deceptive, harassing, hateful, or sexually explicit content, or make false claims about a watch's authenticity, origin, or value.

You grant WSIQ Bids a non-exclusive, worldwide, royalty-free license to host, reproduce, and display content you submit (including stream recordings, listing photographs, and chat messages) for the purpose of operating, moderating, and promoting the platform. Streams may be recorded and retained for dispute resolution.

We may remove content, mute or ban participants, and end a show at any time.

11. Prohibited conduct

You may not bid on your own lots or arrange for others to do so, coordinate bidding to suppress prices, transact off-platform to avoid fees, scrape or reverse engineer the service, interfere with the bidding engine or clocks, or use automated bidding tools without written permission.

12. Disclaimers and limitation of liability

The platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant uninterrupted streaming, error-free clocks, or that a bid will be received.

To the maximum extent permitted by law, WSIQ Bids' total aggregate liability arising out of or relating to the platform or any transaction is limited to the greater of the platform fees we collected on the transaction at issue or USD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost value, or lost collecting opportunity.

13. Indemnity

You agree to indemnify and hold harmless WSIQ Bids and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from your listings, bids, content, shipments, or breach of these terms.

14. Privacy

We collect and process account, bidding, payment, and shipping information to operate the platform, prevent fraud, and comply with law. We share information with payment processors, shipping carriers, and the counterparty to your transaction as necessary to complete it. We do not sell personal information.

15. Changes, governing law and contact

We may update these terms; continued use after an update constitutes acceptance. Material changes will be posted on this page with a revised effective date.

These terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules. Disputes will be resolved by binding individual arbitration or in the state or federal courts located in Illinois; class actions are waived to the extent permitted by law.
